It is advised to consult your local authorities and evaluate travel prohibitions, warnings, announcements, and advisories issued by them before booking travel to international destinations.
By offering travel for sale to specific international destinations, ATW STAYS OPC PRIVATE LIMITED does not warrant or represent that travel to such destinations is advisable or without risk. We are not liable for damages, losses, or delays that may result from inadequate travel documents, entry requirements, length of stay issues, or travel to these destinations.
We reserve the exclusive right, at our sole discretion, to modify, limit, or discontinue the Site or any content posted herein without any obligation to consider the needs of any user.
We also reserve the right to deny access to this Site or any portion thereof to any user at our sole discretion, without prior notice.
No waiver of any provision of these Terms and Conditions shall be binding unless made in writing and signed by our duly authorized representative.
Any dispute arising from or in connection with your use of this Site shall be referred to arbitration. The place of arbitration shall be Delhi, and the proceedings shall be conducted in English as per the provisions of the Arbitration and Conciliation Act, 1996 and its modifications in force at the relevant time.
These terms and conditions are governed by and construed in accordance with the laws of the Republic of India. Any dispute shall exclusively be subject to the jurisdiction of the appropriate courts in New Delhi, India.

Travel arrangements and prices detailed on our websites are provided and coordinated by ATW STAYS OPC PRIVATE LIMITED.
ATW STAYS OPC PRIVATE LIMITED has taken due care and responsibility to verify and check all information on our websites at the time of compilation. However, as this information is supplied by the relevant airlines & GDS in our brochures, it accepts no responsibility for any inaccuracy or misdescription contained in the publications.
Sales of services as contained in our publications are made by ATW STAYS OPC PRIVATE LIMITED only as agent for the person, business, or company providing the services. The standards of air booking and other services chosen are based on various factors, which are generally accepted as indicative of a certain class.
ATW STAYS OPC PRIVATE LIMITED does not accept responsibility for any change in prices or variation of services as shown, and all services and prices are subject to change without notice.
ATW STAYS OPC PRIVATE LIMITED does not accept any liability of whatever nature for the acts, omissions, or default, whether negligent or otherwise, of those service providers in connection with your convention pursuant to a contract between them and yourselves and over whom we have no direct control. We do not accept liability in contract or in tort (actionable wrong) for any injury, damage, loss, delay, additional expenses, or inconvenience caused directly or indirectly by force majeure or other events which are beyond our control, or which are not preventable by reasonable diligence on our part including, but not limited to war, civil disturbance, fire, floods, unusually severe weather, acts of God, acts of Government or of any other authorities, accidents to or failure of machinery or equipment, or industrial action.
It is essential that you check with us, or your travel agent, for any changes or variations to the information shown on our websites. This will allow us to advise you, or your agent, of any such changes that we are aware of either before you book your holiday, or prior to your departure.
Terms and Conditions of Booking
Rates and Price Variations: ATW STAYS OPC PRIVATE LIMITED retains the prerogative to adjust prices and rates in response to fluctuations in exchange rates, increases from wholesalers or suppliers, tax revisions, or other pertinent factors. Should costs escalate, you are required to settle the difference upon notification, or alternatively, opt for cancellation with applicable fees. We bear no responsibility for price adjustments. Quoted rates are valid at the time of quotation and may fluctuate prior to the travel date. All prices are subject to availability and may be withdrawn or modified without prior notice.
Final Payment: Final payment must be remitted promptly upon request before the travel date. Vouchers will be issued upon receipt of final payment in our office. Final payment terms for air travel, car rentals, hotels, and tour products may vary and will be meticulously detailed on respective booking pages. Please note, final payment amounts may deviate from the original booking price or quote due to fluctuations in exchange rates or supplier pricing adjustments.
Card Fees: Please be advised that a card fee is automatically applied to credit card transactions. This fee encompasses various costs associated with processing bookings, including merchant fees from credit card companies, payment processing, administrative tasks, IT system maintenance for payment security, and management of credit card chargebacks and related fees.
Payments made via cheque or direct deposit are exempt from additional charges.
ADM POLICY
Any Agent Debit Memo (ADM) resulting from the following scenarios will be the responsibility of the Travel Partner:
If a booking is aborted during the hold or booking process, please refrain from issuing multiple tickets. Contact our call centre for further assistance to avoid ADMs, for which agents will be held accountable if not compliant with this policy.
Payment Processing Terms & Conditions:
By providing your credit card information and agreeing to our Terms & Conditions, you authorize ATW STAYS OPC PRIVATE LIMITED (operating as SETSTAY) to initiate the debit of funds from your specified credit card. This authorization is governed by the Direct Debit Request Service Agreement, which may be updated periodically.
Please be aware that your bank or credit card issuer may apply fees for currency conversion. Credit card details are required for securing bookings within 14 days of travel.
Standard Cancellation Policy
Flights Cancellation Policy
Special Cancellation Conditions: Certain air, car, hotel, and tour products may have additional cancellation charges. These conditions and costs are specified under pricing on individual pages and will be clearly communicated to you in writing at the time of booking.
Amendment Fees: Any changes made to confirmed bookings will incur a fee per amendment, in addition to any charges imposed by the supplier or airline.
Credit Card Chargeback Fees: Fees incurred by Setstay from our credit card payment provider due to a chargeback or disputed charge on the cardholder's credit card will be billed to the cardholder. This fee is non-refundable.
Change Of Itinerary After Booking Has Commenced: Any alteration or cancellation of services after your booking has commenced may result in penalties. There is no refund for unused services.
Refunds: All refund requests must be submitted in writing directly to us or through the agent from whom the travel arrangements were purchased. Claims must be made before the scheduled departure time. Refunds will not be issued for bookings cancelled due to inclement weather or illness; these should be claimed through your travel insurance. No refunds will be issued for services once travel arrangements have commenced, and we do not guarantee the availability of any refund. In the event of duplicate payment for a transaction, the excess amount will be refunded as a deposit into Setstay's account within 7 to 10 working days after it is received from the airline or supplier into our bank account.
Reporting of Incidents: Any unusual incidents such as injuries, service issues, service cancellations, or dissatisfaction must be reported to Setstay during the event to allow us the opportunity to rectify the situation or provide assistance.
Visas
The Travel Partner affirms that all visa applications submitted are genuine cases and assumes full responsibility for the clients, passengers, or travelers.
The Travel Partner commits to comply with all requirements stipulated by the Immigration and consulates of countries through our office regarding visa application documentation.
The Travel Partner agrees to indemnify and hold harmless M/s Atw Stays OPC Pvt Ltd, its officers, employees, and agents, from all costs, charges, claims, damages, and liabilities arising from passengers not complying with visa grant terms and conditions for their intended countries, for applications submitted through us.
The Travel Partner acknowledges and authorizes Atw Stays OPC Pvt Ltd to process visa applications for various countries. Our role is limited to accepting visa applications and necessary documentation, forwarding them to consulates and immigration authorities for visa consideration, and communicating application status.
Visa applications are evaluated based on individual merit; consulates and Immigration Departments reserve the right to request additional information at any stage of processing.
Immigration authorities and consulates retain the sole discretion to approve or deny visas without providing reasons. Atw Stays OPC Pvt Ltd has no influence over these decisions.
Once a visa application is submitted, charges apply regardless of visa issuance or rejection by immigration/consulates.
It is the Travel Partner’s responsibility to ensure correct document verification before submission to Atw Stays OPC Pvt Ltd, including passport pages, photographs, additional documents for minors, passport observation pages, and any other forms required by immigration/consulates.
The Travel Partner must verify visa categories accurately before submitting requests.
For OK to Board messages in required countries, the Travel Partner must inform Atw Stays OPC Pvt Ltd of the PNR at least 72–48 hours before departure on normal working days, and 96–72 hours before weekends (Friday and Saturday). The Travel Partner must verify and confirm messages with airlines at least 24 hours before departure.
Atw Stays OPC Pvt Ltd reserves the right to reject any application based on our quality check norms and passenger profiles.
Both parties agree to all terms and conditions outlined in this agreement.
Atw Stays OPC Pvt Ltd explicitly states that we have no role in assessing visa applications, which is solely under the authority of the respective countries’ consulates and Immigration departments. Therefore, Atw Stays OPC Pvt Ltd bears no liability for delays or rejections in visa processing.
Visa issuance and approval are solely governed by the respective country’s government and subject to their rules and regulations, which may change periodically.
Visa fees are nonrefundable once applied under any circumstances.
In case of visa application rejection, the applicant will be informed without further correspondence or refund of fees.
Atw Stays OPC Pvt Ltd shall not be liable for delays caused by consulate or Immigration systems errors or technical issues.
Atw Stays OPC Pvt Ltd shall not be liable for any damages, losses, or delays of documents during courier services, third-party handling, or natural calamities. Courier charges are not included in visa fees.
We maintain strict confidentiality of information provided in visa application forms. However, Atw Stays OPC Pvt Ltd is not liable for unauthorized access to this information by any means.
Atw Stays OPC Pvt Ltd is not liable for any fines imposed on passengers involved in criminal offenses.
The decision to permit or deny entry lies solely with immigration officers at ports of entry. Atw Stays OPC Pvt Ltd assumes no responsibility for immigration officers’ decisions.
The Travel Partner agrees to these limitations and experiences and confirms their understanding.
The Travel Partner undertakes to ensure all passengers adhere strictly to the flight schedules submitted with visa applications. The Travel Partner accepts full responsibility for passengers for whom visas are applied. Furthermore, the Travel Partner guarantees all passengers will depart within the visa validity period. Should any passengers overstay or abscond on a sponsored visa, the Travel Partner agrees to pay Atw Stays OPC Pvt Ltd the stipulated penalty within 5 working days of notification, based on the current exchange rate. The Travel Partner confirms that visitors sponsored by Atw Stays OPC Pvt Ltd will not work or violate laws, especially in UAE/Oman/Bahrain/Qatar, and other countries under sponsored visas. The Travel Partner agrees to bear any penalties imposed by consulates, immigration authorities, suppliers, or local authorities, whether directly or through third-party suppliers, associates, or other parties involved in the transaction.
General
Validity of Rates: Prices are applicable for the specified dates.
Currency: All rates are quoted in Indian Rupees, unless otherwise stated.
Payment Options: Setstay provides a secure server for credit card payments. Alternatively, you can fax your credit card details, send a cheque, or make a direct deposit.
Eticket: Your Eticket details will be emailed to the address provided during reservation within 5 minutes.
Accommodation: Accommodation details are as specified on our websites. Costs are in Indian Rupees unless otherwise noted. We reserve the right to offer alternative accommodation of comparable standard if the booked property is overbooked or due to reasons beyond our control. All rates are subject to change without notice. Availability is confirmed upon receipt of booking request, as not all properties offer instant availability.
Flights: Airfares indicate instant availability and prices at the time of quoting. Flight bookings are confirmed only after accommodation is verified to avoid airline charges for amendments, potentially resulting in fare and availability adjustments.
Check-In / Check-Out Times: These vary by property. Generally, check-in is at 2pm and check-out at 10am. Most properties require credit card authorization at check-in and may request photo identification. If a credit card is unavailable, a cash bond is typically required.
Single Supplement Costs: If not included in the accommodation cost, please inquire for details.
Accommodation Ratings: Ratings are based on our assessments and in collaboration with our hotel suppliers. They serve as guidance and do not imply AAA endorsement.
Group and Incentive Travel: Group and conference rates have specific terms and conditions tailored for those bookings. For group or incentive bookings, ensure you are briefed on these conditions.
Maps, Photographs, and Illustrations: Included for general reference only. Hotel room photographs may not depict the specific room allocated. Maps are not to scale.
Quotations: Subject to availability until booking confirmation and receipt of deposit. Quotes remain valid for 48 hours from the date of issue.
Change Fee: Setstay charges Rs. 250 per change per person, irrespective of the service type (e.g., flights, hotels, etc.). (Over Above the standard flight/hotel change fee)
Cancellation Fee: Setstay charges Rs. 250 per cancellation per person, irrespective of the service type (e.g., flights, hotels, etc.). (Over Above the standard flight/hotel cancellation fee)
Inclusions and Exclusions
Prices DO Include: Accommodation, transfers, tours/cruises, car hire, government taxes, and any other specified inclusions as detailed on the relevant web pages for each supplier's product.
Prices DO NOT Include: Costs incurred en route to and from the destination, meals (unless specified), alcoholic beverages, telephone calls, items of a personal nature, and personal services not explicitly stated as included in the costs on the relevant web pages for each supplier's product. Rates also exclude Marine Park taxes, which must be paid directly to the operators.
Copyright Notice:
The copyright on all original/custom artwork, maps, navigation elements, presentation methods, and design elements included on our websites is exclusively held by Setstay. Copyright on all descriptive text is also held by Setstay. Selected photographic images are reproduced with the permission of Setstay and the product/service providers represented on the website, or as indicated where necessary to comply with copyright obligations for their electronic reproduction.
Where joint copyright is held over proprietary text or images, Setstay reserves the right to pursue all copyright infringements on behalf of the primary copyright holder. In cases where the copyright for a photographic image is exclusively held by a third party under license, Setstay reserves the right to vigorously protect the copyright of those images on behalf of the third party.
All HTML files used in Setstay websites are proprietary software products developed solely for use by Setstay and are subject to international intellectual property conventions.
All custom graphics used are considered works of art created exclusively for use by Setstay and are subject to international intellectual property conventions. Image files, HTML documents, and text files may not be relocated to another server or duplicated for commercial purposes without the express written permission of Setstay.
Setstay, operating under its subsidiary business names, is a member of various Indian Regional Tourism Authorities. As such, Setstay retains the right to reproduce images provided by these organizations to their members for the purpose of generic and/or specific tourism promotion.

Terms and Conditions of Online Payments
Payments/Top Ups/ Paid for Order:
Please note that any transaction conducted via online payment by our registered agents or in-person customers will be processed through an agent. For walk-in customers swiping their card for a booking or wallet update, the cardholder bears full responsibility. Any disputes or chargebacks will be handled by the Setstay registered agent.
Wallet Update:
In cases where a transaction is successful through any online payment mode but the booking fails, the transaction amount (excluding payment gateway charges) will be credited to the Setstay Agent ID wallet. Refunds will be processed based on standing instructions from the Setstay Agent through the respective payment mode used during the transaction.
Payment Gateway Fees:
Please note that payment gateway fees will automatically apply to online payment options. These charges are non-refundable under any circumstances.
Payment Processing Terms & Conditions:
By providing your credit card details and accepting our Terms & Conditions, you authorize Setstay to debit funds from your nominated credit card according to the terms of the Direct Debit Request Service Agreement, as time to time. Your bank or credit card provider may apply currency conversion fees. Credit cards are required to secure bookings within 14 days of travel.
Credit Card Chargeback Fees:
Any fees incurred by Setstay from our credit card payment provider due to a chargeback or disputed charge on the cardholder's credit card will be passed on to the cardholder or registered agency. This fee is non-refundable.
Outstanding:
In cases where outstanding payments remain unpaid despite multiple reminders, Setstay reserves the right to recover them from future bookings.
Payment Options:
Setstay provides a secure server for credit card payments.
Promotion
